US Judge Mandates Freedom of Abrego Garcia from ICE Detention
A federal judge has ordered the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing detainment is without lawful basis.
"Since his release after erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her ruling.
The case originates in a erroneous removal to El Salvador in March, which the government later admitted was an error. Following his repatriation to the United States to answer human smuggling allegations, he was detained in immigration custody.
In her decision, the court pointed out that the government lacks a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."

The court proceedings center on disputed assertions. Whereas the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this claim.
He has also pleaded not guilty to the conspiracy counts, which are part of a separate criminal case in the state of Tennessee.
